Tangibly AI Terms and Conditions

1. Terms and Conditions
These terms (“AI Terms“) govern Your use of the artificial intelligence (“AI“) and large language model (“LLM”) services or features available through the Tangibly Predicted Portfolio™ platform (“Platform”) and take effect when you click the “I Accept” button below or by accessing or using the AI and LLM Services or features.

2. Acceptance of the AI Terms
BY CLICKING ON THE “I ACCEPT” BUTTON BELOW OR BY ACCESSING OR USING THE AI AND LLM SERVICES OR FEATURES YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS AND CONDITIONS; (B) REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THESE TERMS AND CONDITIONS AND, IF ENTERING INTO THESE TERMS AND CONDITIONS FOR AN ORGANIZATION, THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ORGANIZATION; AND (C) ACCEPT THESE TERMS AND CONDITIONS AND AGREE THAT YOU ARE LEGALLY BOUND BY THE TERMS CONTAINED HEREIN. IF YOU DO NOT ACCEPT THESE TERMS OR PAY THE FEES DESCRIBED BELOW, YOU MAY NOT ACCESS OR USE THE AI AND LLM SERVICES OR FEATURES.

3 License
在您支付下述费用的前提下，Tangibly特此授予您有限的、可撤销的、非独占的、不可转让的和不可再许可的使用AI和LLM服务或功能的许可。使用AI和LLM服务或功能须遵守任何及所有适用法律和本AI条款。您理解并承认，使用人工智能和法律关系管理服务或功能并非Tangibly商业秘密保护平台的强制性或默认集成。

4. AI Content
The output insights generated and returned by the AI and LLM services or features (“Output”) are based only on the publicly available information and data provided by You and processed on and through the Platform (“Input”). The Input and Output are collectively referred to herein as “AI Content.” You are solely responsible for ensuring that the AI Content complies with applicable laws and these AI Terms. You acknowledge that due to the nature of machine algorithms that power the AI and LLM services or features, Output may not be unique or novel and the AI and LLM services and features may generate the same or similar Output for other users.

5. Accuracy

6. As Is and As Available
The AI and LLM services or features are currently provided through proprietary artificial intelligence technology developed and offered by Tangibly. Tangibly reserves the right to modify or revise such proprietary artificial intelligence technology at any time and from time to time without providing notice to You or any third-party. You agree to limit your Inputs to information and data that is publicly available and not use or provide any information that is sensitive or that should not be viewed by others, including personal data. You assume the risk for any violation of privacy laws or loss of intellectual property protection due to Your Input. Tangibly has no control over the use of the Input, and any use of such Input is at the Customer’s own risk. Tangibly does not represent, undertake or warrant to any security or control of or to the Input or Output.

THE AI AND LLM SERVICES OR FEATURES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TANGIBLY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE AI FEATURE, OR THE INFORMATION, TEXT, AND AI CONTENT INCLUDED IN THE OUTPUT, OR THE USE OF THE INPUT, INCLUDING WITHOUT LIMITATION, ACCURACY OF THE RESULTS, AVAILABILITY, SUITABILITY, RELIABILITY, OR AI CONTENT OF ANY INFORMATION PROVIDED THROUGH THE AI AND LLM SERVICES OR FEATURES. YOU UNDERSTAND THAT AI CONTENT MAY BE SUSCEPTIBLE TO RISKS COMMONLY ASSOCIATED WITH INFORMATION STORED ON THE CLOUD OR GENERATED USING MACHINE LEARNING ALGORITHMS. TANGIBLY WILL HAVE NO LIABILITY OR RESPONSIBILITY ARISING IN ANY WAY FROM THE USE OF THE AI AND LLM SERVICES OR FEATURES OR ANY ERRORS OR OMISSIONS CONTAINED IN THE AI CONTENT. NEITHER TANGIBLY NOR ANY OF ITS AFFILIATES OR LICENSORS WILL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, OR DATA OR OTHER LOSSES, EVEN IF TANGIBLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Feedback
You may provide your feedback regarding the AI and LLM services or features (“Feedback”) via email at the following address: support@tangibly.com. The Feedback can include feedback on the performance, features that may be missing, and any bugs encountered during the use of the AI and LLM services or features. Any Feedback provided grants Tangibly a perpetual, irrevocable, non-exclusive, worldwide, fully-paid, sub-licensable, assignable license to incorporate it into the Tangibly Platform or otherwise use any Feedback received from you to improve Tangibly offerings. You irrevocably waive any moral rights in such Feedback pursuant to applicable copyright law. Tangibly acknowledges that any Feedback is provided on an “as-is” basis with no warranties of any kind.
