EVPは日本の不正競争防止法違反で訴えられた。 同法は、営業秘密は秘密として管理され、事業に有用であり、公然と知られてはならないと定めている。 同法違反は刑事犯罪であり、彼は警察に逮捕された!

裁判でも控訴審でも、裁判所は、主張された営業秘密はあまりにも抽象的で漠然としており、明確に定義されているのではなく、広く一般的な技術的知識を包含していると判断した。

元EVPは現在、愛知製鋼を120億円(約9100万米ドル)で訴えている!
