Today we\u2019re going to be talking eventually about trade secrets, but first we\u2019re going to be talking about copyrights.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> We\u2019re covering the biggest news in intellectual property in the past couple of weeks, the Anthropic case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anthropic is the AI company that produces the product Claude, and it\u2019s become a behemoth very quickly. One of the fastest growing startups in history. They\u2019re doing about a five billion dollar run rate as we speak, and they just closed a financing round of thirteen billion at a one hundred eighty three billion dollar valuation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (02:02)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yeah, one hundred eighty three billion valuation, which is amazing.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (02:06)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> A lot of happy investors. So let\u2019s talk about Andrea Bartz and the other plaintiffs in this case. Who is she? And then let\u2019s get into the guts of the case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (02:30)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Andrea is a book author, apparently a quite successful one. She\u2019s written five books, which is five more than I\u2019ve written.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> She and her class said that the scraping that was done by the AI system of all their book contents was copyright infringement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (02:35)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Five books? Five more than I\u2019ve written. Yep. Me too.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (03:00)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> It led to a compelling case balancing the needs of two groups.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> On one hand, you have authors who spend time and effort to produce books. On the other, you have the large language model industry that needs massive amounts of data to function.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">They argue they need to do this to have a viable industry. But copyright holders say, \u201cYou can use my content, but you have to pay me for it,\u201d just like if someone made a physical copy of a book.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It led to a lot of back and forth and ultimately a massive one point five billion dollar settlement, the high watermark for copyright infringement, which was approved by the judge just days ago.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (04:05)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yeah. Anthropic, as well as OpenAI, is in a lawsuit right now with the New York Times and probably others.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The LLM folks argue this is fair use, that this information is out there, and they can read it, learn from it, and build products from that learning.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> But the Anthropic settlement basically says fair use is not enough, you have to pay for it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (04:46)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Well, it\u2019s not like they were copying one sentence or summarizing a story. They were copying entire books, and certainly for commercial purposes.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It wasn\u2019t parody or commentary, it was commercial use. The authors said, \u201cThis is blatant copying for commercial gain, and you\u2019re copying my entire catalog.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">OpenAI\u2019s case with the New York Times is the same story, just with news content instead of books.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (05:40)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> So if I want to learn something from a book, I buy the book, I read it, and I pay for it.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> If I want to use the learnings from that book, I can, but I can\u2019t plagiarize it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So is that the right analogy here? If I want to go learn from the book, I have to pay for the book. Is that effectively what this means?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (06:34)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> That\u2019s effectively it. You\u2019re getting a license to consume the book for your own purpose as a normal consumer.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> And it\u2019s meant to reward creative people.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If anyone could copy books for free, why would people write new books? That\u2019s the whole premise of IP law, to reward creation.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> When someone copies without permission, the creator deserves compensation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That principle applies here just as well.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (07:32)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Right. So did OpenAI\u2019s lawyers just have a couple of all-nighters figuring out a new strategy in that New York Times litigation or what?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (07:53)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yeah, I think so. This is a unique situation.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Before large language models, no one would physically photocopy millions of books. It just wasn\u2019t possible.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Now, technology allows it. So all these models are doing the high tech version of photocopying entire libraries.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Technology forces IP law to evolve. We\u2019re facing situations that would\u2019ve never happened otherwise.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (08:48)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> That\u2019s super interesting. You and I have talked about AI\u2019s impact on trade secrets and patents.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The standard is that AI can\u2019t be an author on a patent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (09:09)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> And can\u2019t be a creator of a copyright either. AI isn\u2019t an inventor or artist.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (09:16)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> But it could be the inventor of a trade secret, right?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (09:24)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yes. Trade secrets are different. They don\u2019t require a human creator. There\u2019s no such thing as an inventor of a trade secret.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The idea of an AI creating a trade secret is perfectly fine because there\u2019s no human requirement like there is for patents or copyrights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (09:30)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Right. Exactly. Fine. Okay, yes, you\u2019re being a lawyer.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> We\u2019ll just call it the trade secret creator. There you go.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Anyway, my point was this settlement feels like the first big step in bringing some clarity around what the future looks like with AI and copyright.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (10:33)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> That\u2019s right. And these litigations are just the start.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ultimately, this becomes a cost of doing business for large language models.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> At first, I reacted like most people, wow, one point five billion is a lot of money.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> But if you look at it as a tax or royalty to get access to all this content, it\u2019s actually not that bad.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (11:12)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yeah. Let\u2019s get into that.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> A billion and a half, and their valuation is one hundred eighty three billion. This isn\u2019t going to kill them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This was a one-time cost, not an ongoing royalty. But it\u2019s not the end either because they scraped everything, not just books.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (11:52)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> That\u2019s right.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (12:18)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Music, lyrics, anything creative.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (12:23)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Exactly. Music is a whole other category that was likely scraped too.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (12:35)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Right, we\u2019ll save that for another podcast.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> So, when this one point five billion dollar check clears, who\u2019s getting it?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (12:39)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> It gets distributed to the authors. Each author gets a fixed amount, around three thousand dollars.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (13:05)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Don\u2019t worry, we have a lot of dog lovers in our audience, Chris. Someone\u2019s at your door.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (13:09)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> We do. But yes, the authors each get paid.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> For some, three thousand is small, like for bestsellers.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> But for someone who sold two copies to family, that\u2019s a windfall.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (13:39)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Right.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (14:10)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> It\u2019s a huge group, about half a million authors.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (14:19)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Even if they owe ten times that, that\u2019s still maybe ten billion total, half a percent of their value. Manageable.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (15:05)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Exactly. It\u2019s an amount they can handle. You don\u2019t want royalties so high they kill your business model, and that\u2019s not the case here.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (15:10)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yeah. I think this settlement is good news for both sides.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> The authors get something, the company moves on, and it sets a precedent.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Other AI companies will likely owe similar payouts now.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (16:01)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Yes, and most authors will be happy with that. It\u2019s fair and it provides certainty.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (16:08)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Totally. I think it\u2019s a good outcome for the whole industry.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (16:35)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> It makes sense and fits the philosophy of IP. Large language models pay for what they used, and creatives continue creating.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (17:05)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Awesome. So if the copyrighted material is worth one percent of Anthropic\u2019s value, what are their trade secrets worth?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Chris Buntel (17:25)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> A lot more. The copyrighted material was just input, like buying materials to build a factory.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The real value is in the trade secrets, the technology that powers the models.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim (17:57)<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> Right. So why do you need to create this fictitious legal person? So one is obviousness, which we'll talk about a lot. The other is enablement. How much do you have to teach and guide someone in a patent application depends on who's reading it. So the more skilled and better an expert it is, the less guidance they need.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>to make and use your claimed invention. So this person of ordinary skill in the art, skilled artisan, actually comes into play a couple of different ways. And it's either a good thing or a bad thing depending on if you want the patent to be valid or if you're trying to knock out the patent.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Tim (03:12.683)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>That's right. OK, so where this got started in the last 48 hours of our life is I put out this LinkedIn post, soliciting all of our friends to point us to anything written about this topic of the intersection of AI and patents, in particular when it comes to obviousness or non-obviousness.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>and the topic of trade secrets and that is, is a sort of a different standard, but, but, but similar in a way readily ascertainable. so anyway, we've got some really great, a few really great, sort of followups on that thread. There's a piece that, I'll just give a little shout out to Robert Plotkin, really great piece that he.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>wrote somewhat recently, January, 2025. He's a patent attorney, does a lot in software. And this piece that he published on IP Watchdog is really great. And it really sort of gets at the heart of the question I was asking, which is essentially, if you can envision a world, well, even<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>today's world, but let's just like project out a little bit further where these AI systems are incredibly capable at predicting things and having the answer. And I think this example that we talk about, or he talks about in the article is, you know, some chemistry, right? You know, a new molecule for whatever, or, you know, a new design for a semiconductor.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>can imagine now that this person having ordinary skills in the art has access to these AI systems, which can kind of give you an answer sort of straight away, right? So it's not like you had to toil for five or 10 years to figure out that answer. You just went over to your computer, typed in some inputs and there's your answer, right? So there's your new molecule and it should work for all these reasons, you know, go make it.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Tim (05:37.939)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>I guess the somewhat cynical is not quite the right word, but I'll just say cynical view is, okay, if the entirety of human knowledge is going to be readily accessible, if new and interesting capabilities are going to be a few clicks away or answers to problems are just a few clicks away, like where in the heck does that leave the patent system?<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>And then we'll get into trade secrets in a bit, but I guess I postulate, like, isn't everything going to be obvious in a way or meet that obviousness standard simply because skilled artisans are going to know, well, I use this model to do this, right? And there's the answer.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Chris (06:29.194)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Yeah, and obviousness, it's one of those words that give patent lawyers headaches or conniptions because it doesn't mean what it means to average normal people. So in the patent world, it's not obvious to try. Like fundamentally AI is another tool that happens to be incredibly powerful. But it makes that prediction of whether something will work or not much more predictable. So you're right. Like the ability to have someone say, or a patent office say, your invention that you're trying to patent is obvious.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>becomes a much more compelling argument. And you as a patent seeker, patent applicant, you're gonna have to jump over a higher bar than you used to because the tools are suddenly much more powerful. So it really, it will change the landscape and make it more difficult for a patent applicant.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Tim (07:53.641)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Yeah. And I've read Robert's IP watchdog piece a couple of times now. It's really good. It's optimistic for sure that the patent system will still be standing. It'll find a way to adapt to this new world order. think one of the super interesting things that's probably happening in real time right now, and nobody's quite<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>sort of put their finger on it, is that you have machines that are inventing. I mean, let's be serious. The machines are totally inventing, okay? And then the human steps in, does some analysis, and that sort of collective becomes the invention. And that collective goes into the patent, okay? So I'm being maybe a little crass, but that's kind of probably what happens in a lot of today's invention. Okay.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>You can see a world like forming sort of very quickly where you're going to have people trying to invalidate patents left and right because they're going to say, the machine invented that. You didn't invent that. And so isn't it, aren't we sort of staring down the barrel of this? Like, well, you're going have to sort of, you're going to have to be in a position as the inventor to show where the invention was.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>but where the human step was.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Chris (09:26.102)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Yeah, that's totally right. This is almost like the, this is like in a weird way, an extension of that or the converse or something where you're saying, look, in terms of the human step of whatever invention was, and if you're,<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>read Plotkin's piece, it's pretty good. It's sort of saying, yeah, like, hey, I got all this data out of the machine. I went off and I thought about it. I saw this pattern. I saw that pattern. Good, good, good. I went and, whatever, told the machine to go do some more stuff, did some more analysis. There you go. That whole package. That's the innovation, right? Now, what part of that are you going to patent? Well, that's going to depend, right? But certainly that human step piece of it is critical. And it does feel a little bit like<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>writing that down and making it clear that that was a human step is probably like super important right now. Like it's almost like the corpus of human knowledge is just gonna go on some weird exponential. And then it's like kind of a prior art issue, you know?<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>It's just, it's already out there, you know? Like, you know, name your favorite, like encyclopedia or Wikipedia or whatever, you know, whatever, you know, data source you want. It's just gonna already be there. I don't know. But much in the same way, if I say, Hey, this is my trade secret, right? This machine.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>training protocol, cetera, et cetera, right? Whatever it is. What do you think?<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>What do you think happens in that same world order where you've got this infinite amount of human knowledge or infinite amount of capability with computers where you can just say, hey, go figure out how their algorithm works. Like in other words, nobody can figure out quite figure out the TikTok algorithm, but maybe give it a few more years and the machine will figure it out. And so that trade secret that was the TikTok algorithm,<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>maybe isn't really a trade secret anymore because now the machine can predict it. How do you react to that? Yeah, it's actually, you know, something we've never really sort of talked about this, but much like in, in the patent world where you have, you know, composition of matter, you've got design, you've got, process methods, whatever. yeah, we, that'd be neat to sort of like, try to figure out also framework like that. And then, and maybe it is the same framework, for trade secrets, but,<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Chris (31:45.07)<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>here. I think today's discussion has convinced me that that's probably true. it's, and it's not completely clear if it's eating your IP.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>you know, slowly for now, but it's going to accelerate very fast or if it's just, you know, a bit of a, you know, if, if it's sort of slow and steady, but as you say, you know, this sort of also may, may increase the amount of IP, right?
