-to the extent that trade secret protection displaces patent protection in some emerging technologies, trade secret litigation will continue to boom.
– the emergence of litigation funding ……..now that some smaller companies can get help financing more costly litigation, they can better survive the long haul of a damages case and get their case to a jury.
