In this 2017 case, ALLIANTGROUP, LP initiated legal action
against former employee Brad Mols, alleging breach of contract,
misappropriation, and wrongful use of trade secrets, and sought
temporary and permanent injunctions. The case arose from
Mols’ resignation and subsequent actions that directly
competed with ALLIANTGROUP, including solicitation of clients
and misuse of confidential information. The court found the
forum selection clause within the Employment Agreement
enforceable, thus establishing personal jurisdiction in Texas. It
largely denied Mols’ motion to dismiss, except for the claim of
tortious interference. This case did not specify if it was a DTSA
claim but highlighted the importance of trade secret protection
in employment contexts.
